The FAME Marketplace provides a digital environment that facilitates access, monetisation and reuse of data assets. For this, the Legal Framework supports the proper functioning of the Marketplace, through all of its functionalities. This framework has been designed to guide the onboarding phase and provide conditions for participation within the Marketplace. In addition, it aims to enhance the security of the Marketplace environment, facilitate the exchange of data, and set a minimum standard for agreements between buyers and sellers of data assets within the Marketplace.
The Legal Framework is made of three (3) key components: Core Values & Onboarding Procedure, Marketplace Terms & Conditions, and Suggested Transaction Terms, which collectively aim to ensure that the appropriate participants and data assets are placed on the platform and that every participant can operate in a transparent and predictable environment.
All the participants of the FAME Marketplace shall be aware of the Core Values & Onboarding Procedure, since this component outlines the core values supported by the FAME Marketplace, along with the procedure for the onboarding of all applicants to the FAME Marketplace. It designates certain roles and responsibilities to ensure the orderly assessment of each application.
What is more, all the participants shall be informed about the Marketplace Terms & Conditions, since this component provides all the information related to any products, core or non-core services, to the website, or any other element provided on the Marketplace, which participants may, directly or indirectly, benefit from. These ‘Terms’ apply whenever the Marketplace is visited or used by a participant. Thus, all the participants shall carefully read these terms before engaging in any activity on the Marketplace, as participation of any kind within the Marketplace is considered as an acceptance of the ‘Terms’. The Marketplace reserves the right to make any changes to the ‘Terms’ from time to time, and without prior notice, whilst these terms are provided in English.
Finally, the participants interested in being involved in the trading functionalities of the FAME Marketplace, they shall be aware of the Suggested Transaction Terms, since this component provides the general rules of engagement for the relevant parties involved in a transaction within the FAME Marketplace. Hence, these ‘Transaction Terms’ aim to facilitate and regulate such transactions, or otherwise, the reciprocal exchange between an Offeror and User, within the Marketplace.
